TJOFLAT, Circuit Judge: In these consolidated appeals we must decide whether a restrictive covenant in a contract of employment is enforceable under state law, and whether its attempted enforcement constituted a violation of sections 1 and 2 of the Sherman Act.1 We find that the restrictive covenant is enforceable and not a violation of section 1 of the Sherman Act; we do not address the substance of the section 2 issue because the issue has not properly been framed for appellate review.
